Abstract
The use of mercury in gold mining business activities of small scale is oa
phenomenon that occurs in various parts of the world, including Indonesia. In Indonesia the use
of mercury is rife all over the country one of which is on a small scale gold mining activities in
Botak Mountain Buru Regency of Maluku province. The use of mereury in gold mining activities
have threatened the survival of mankind. These conditions encourage the Indonesian
Government to draw up a legal political order to eliminate the use of mercury in m
activities. This study aims to identify and understand the background or reasons people
perpetrators of the business activities of small-scale gold mining using mercury in mining
activity at Botak Mountain Buru Regency of Maluku province and the description of the legal
political ideal in the management of the elimination of the use of mercury in gold. To achieve
these objectives it is used non-doctrinal legal research (non-doctrinal research) with th
approach based on socio-legal research, and the paradigm of constructivism and relies on
qualitative research with decision/determination by purposive sampling, inductive analysis ana
grounded theory. The results showed that first, fundamental reasons the use of mercury in gold
mining activities of small scale Mount Bald, Kapubaten Province Labor Ambon ie knowledge
about the methods of how to mine the gold held by the public as a miner is still modest, the
ommunity as a miner does not know that mercury used in stages of mining used harmful to th
health of the environment, and because of the abundance I availability of mercury at an
affordable price. Second, the political ideal law, the abolition of the use of mercury in the
business activities of small scale gold mining in Indonesia should be prepared based on a
global perspective (Convention Minamata), national perception (Pancasila, the Constitution,
and legislation related), as well as theoretical studies (theory of legal system and the theory of
sustainable development)
